These are Ebco’s Terms and Conditions of sale to which all online purchases are subject. Please note for the purposes of these terms and conditions any reference to Ebco shall be construed as meaning  EBC Limited (Company number 06938985 registered office 5 Pegasus House Olympus Avenue Warwick CV34 6LW – VAT number 979396929). We reserve the right to alter these terms and conditions at any time, without notice. Any changes will take effect when posted on this website.

By using this website you agree to be bound by these Terms and Conditions. These Terms and Conditions do not affect your statutory rights.

1.Contract

1.A OFFER AND ACCEPTANCE
Acceptance of your order and the completion of the contract between us (Ebco) and you, (the customer), will be effective when the goods have been paid for by you and despatched by us. Any email, order confirmation or other electronic acknowledgement by us of receipt of an order does not constitute legal acceptance by Ebco of your order.

In the event that there are any errors regarding price or description, we reserve the right to notify you as soon as possible and give you the options to proceed with this revised order at the correct price/description, or to cancel the order. In these circumstances, upon cancellation, your PayPal account/ credit/debit card will be refunded in full.

1.B PRICE
The prices shown only apply to purchases made online through this website . Prices payable and promotions offered online may from time to time differ from those prices and promotions offered by retailers or otherwise by special offers or promotions through advertisement in the media. We are under no obligation to honour any price or promotion offered by retailers or in the media that differs from those online.

All offers are subject to availability and while stocks last.

All prices are shown in £ sterling and include V.A.T. where appropriate. We regret we are not able to offer VAT exclusive pricing for deliveries to locations in which V.A.T. is not payable.

If an administrative error has resulted in an incorrect price being displayed on this website, we reserve the right to correct that price and notify you accordingly. In these circumstances, it will be deemed that a contract has not been entered into and you will not be bound to continue with your purchase. You will be asked to email us to confirm that you wish to proceed at the correct price, however, should you choose not to do so, your monies will be refunded and the repayment of such monies shall be in full satisfaction of our liability to you.

2. Ordering

Whilst we normally only accept orders online originating from and for delivery to UK addresses if you wish to order either from outside the UK or for delivery outside the UK please contact us on exportsales@ebco-ebikes.co.uk  to obtain quotations and terms for the sale and delivery of products.

To order goods online thorough this website, you need to select your required items from the appropriate product information page(s) and then follow the steps outlined below:

•    Product Information Page: Select the quantity you require by completing the relevant field and choosing the colour and frame size you require. Click the “Add to cart” button to add this to your shopping cart. When the item has been successfully added to your cart a message will display at the top of the screen indicating the product has been added and asking if you wish to go to checkout or to continue shopping.

•     Checkout Page: Click “Go to Checkout” when the message appears, or click the “items in your basket” link at the top of the page. Your chosen items will display here, as well as the option you specified – quantity, colour and frame size. You are able to update your order, or delete items before proceeding. On this page you also specify delivery options, your billing address – this must be at the address at which your Pay Pal account/credit/debit card is registered – and email/phone contact details so we can contact you if we need to discuss your order. Please complete your details in the appropriate boxes. We also ask for your delivery/shipping address, if different from the billing address.

•    Order Summary Page: Finally, we will ask you to check the details of the products you are ordering, along with your billing and delivery addresses. If you have a promotional code, enter it in the box provided and press ’Submit’, and your order will be automatically updated. Then complete the details of your PayPal Account and don’t forget to tick the boxes confirming you have read these Terms and Conditions and to allow you to be contacted by us via email if you wish to. Clicking ’Order Now’ will generate and transmit your order and display a page confirming the details of your order for your records. Unfortunately, due to the speed of our order processing, you will not be able to amend your order after pressing the ’Confirm Order’ button, so please check all details are correct before placing your order.

Ebco will confirm receipt of your order by sending an email to you, using the address you supplied when registering with our website. This email is only an acknowledgement and does not constitute legal acceptance by us of your order.

All orders placed on Ebco are subject to stock availability and to the validation checks described in section 4 below. Also please refer to section 1B above regarding incorrect prices. No contract will exist until payment has been received and goods have been dispatched. This will be deemed to be our acceptance of your order and to have been effectively communicated to you.

Please note that the only language in which the contract can be concluded is English. Ebco will retain details of your order in our database and these details can be made available on request. Please contact our customer service team at customerservices@ebco-ebikes.co.uk

3. Payment

PAYMENT BY PAYPAL
Payments should be made through PayPal. All you need is a PAYPAL account. For full details and PayPal’s Terms and Conditions please go to www.PayPal.com

Once you have a PayPal account select Paypal on the payment page and you will be directed to a log on screen. Once you have logged on, you will see all your order details and be asked to confirm payment. On confirming payment you will then be presented with your order confirmation page.

You will receive an email from Ebco confirming your order, and two further emails from Paypal, one notifying that you have authorised a payment on your Paypal account, and one to confirm payment once we have dispatched the order.

4. Credit Checks

All PayPal account holders and credit and charge card holders are subject to credit validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

In addition, in the interests of preventing fraudulent use of credit, debit and charge cards, Ebco will validate the names, addresses and other information supplied during the order process against commercially available records (e.g Electoral Roll data, Credit Reference Services). A third party may also be instructed to complete these checks. By ordering from the  www. ebco-ebikes.co.uk website you consent to such checks being made. We may need to contact you by letter, telephone or email to verify details before we are able to process and dispatch your order or we may be unable to accept your order. Any information given may be disclosed to a registered Credit Reference Agency which may keep a record of the information. All information provided will be treated in accordance with the Data Protection Act 1998. These measures are taken as extra protection for you, to ensure your online shopping experience with us is as safe and secure as possible.

5. Delivery

Delivery charges  to mainland addresses in the UK other than remote addresses will be at the Ebco delivery charges as indicated in the Checkout section of this website. For deliveries to non-mainland UK addresses and certain remote locations e.g. Scottish Isles, Isle of Man, Isle of Wight, Northern Ireland and the Scottish Highlands there may be an additional delivery charge and slightly longer delivery lead-time. This charge will be shown clearly during the checkout process. Goods can be delivered either to your home address, to an alternative address or to your work. If your order is for delivery outside the UK as indicated in section 2 above you should contact exportsales@ebco-ebikes.co.uk to obtain a quotation for delivery charges you may also be required to pay import duties and taxes. All and any such duties, tax and custom charges are your responsibility

Your order will be delivered either by Royal Mail, Royal Mail Recorded Delivery or by courier. A signature is required for all Royal Mail Recorded Delivery and courier deliveries. If your order contains more than one product the individual products may, on occasions, be sent on multiple dispatches at no extra charge.

You can choose from our Standard Delivery or Special Delivery services. Standard Delivery of stocked items is normally within 7 working days. Delivery times are calculated in working days – i.e. Monday to Friday inclusive (working days do not include weekends or National Bank Holidays). In case of Bank Holidays please allow an extra 2 working days.

Risk in the goods will pass to you on delivery.

Delivery times quoted above can vary depending on stock availability and delivery location. We reserve the right to alter or amend delivery times in exceptional circumstances. We do everything we can to meet the delivery time specified in this section, however occasionally delivery times may be affected by factors beyond our control and cannot be guaranteed. We will inform you if we become aware of an unexpected delay.

7. Guarantees and Limitations

All products are subject to the terms of guarantees or warranties issued with them and you as the customers are reminded that you should complete all guarantee and/or warranty cards/documents immediately upon receipt of goods where appropriate.
Any advice given by agents or servants of Ebco during telephone/Internet orders is based entirely upon information given by you the customer. Where advice is given after visual inspection by agents or servants of Ebco, such advice shall amount to an opinion only and Ebco shall not accept liability for any inaccuracies. Additionally, goods are supplied only to correspond to the purpose for which goods of that kind are commonly supplied and not alternative uses to which they may be put. No liability for failure can be accepted by Ebco for such alternative use, amendment or modification.

Compatibility of goods is not guaranteed where modifications or alterations have been made and, in such circumstances, any refunds to you the customer shall be at Ebco’s sole discretion.

Where goods purchased by you are alleged to be defective, you agree to advise us of such defects within 7 days  of the goods being delivered to you or the defect becoming apparent and  you agree within 7 days thereafter (and in accordance with our Returns Policy (see 10 below)) to arrange for the return of such goods to us for inspection and report (without us replacing the said goods prior to such inspection).

You further confirm that it shall be reasonable for us to inspect, repair or replace (at our option) such defective goods and allow our manufacturers or suppliers to undertake inspections so as to allow production methods to be modified. You also accept that it is reasonable to inform us of any interruption, defect or other failure prior to contacting independent third parties or incurring expense and, in addition, to allow us to remedy the defect. Parts improperly fitted, assembled, modified or adapted by you shall no longer be warranted by us or any manufacturer or supplier to us nor shall they or we be liable for any failures resulting subsequent to modification.

We shall accept no liability for death or personal injury unless caused directly by Ebco’s negligence in circumstances where assembly has been effected otherwise than in strictly in accordance with the instructions set out in the Handbook and/or attached to the product or where  modifications or alterations and/or poor or irregular servicing or maintenance to goods have been made. No liability is accepted by us where you attempt to modify or install components supplied where it is known or ought reasonably to be known that the part supplied is incorrectly supplied, defective or otherwise not in accordance with the order.

We accept no liability for accidental or consequential damage or loss or any other matters beyond our reasonable control or in respect of failure to supply or other interruptions caused by strikes, lockouts, civil disputes, acts of God, war or actions by third parties.

8. Restrictions on Ordering and Delivery

Where a person attempts to buy goods where minimum age limits apply, the contract will be deemed void where the individual is below the required age limit.

9. Complaints and Queries

If you are not happy with any aspect of our online service, discover a fault with our website, or if you have any queries or comments relating to an order placed online, please  contact us at customerservices@ebco-ebikes.co.uk and we will do everything we can to help you.

Your access to our website may occasionally be restricted to allow for the introduction of new products or features, site development, maintenance or repairs. We will attempt to restore the service as soon as we reasonably can.

10. Returns Policy

If you decide that you do not want any item that we have delivered, we will offer you an exchange or refund within 28 days of delivery, provided that it is returned to us in its original and unused condition (including in its original packaging), along with the wrapping and delivery note (as proof of purchase).

METHODS OF RETURN ARE AS FOLLOWS:
1) By post – only to be used where goods have been posted to you
To return an item by post you must first contact our customer services at customerservices@ebco-ebikes.co.uk . We will issue a Returns Authority which must accompany the goods being returned. Items returned without a Returns Authority cannot be accepted.

You must advise us which item(s) you wish to return (if the item is alleged to be defective you must follow the arrangements detailed in 7 above and provide the details of any fault) along with your customer order number and your personal details and we will send you an email containing a Returns Authority. When you receive this email, simply print out the Returns Authority and place it in your parcel with the item(s) you wish to return. Please package your item(s) securely, returning in the original outer packaging where possible. All items returned by post (unless faulty) are returned at your cost. You are advised to obtain a certificate of posting (available from all Post Offices at no charge) when returning items by post. If you post your item(s) back to us, we will endeavour to send you a replacement or refund your payment within 14 days, providing your Returns Authorisation is included with the items returned.

2) Collection by Ebco – where goods have been delivered by courier
Depending on the size and weight of the item you wish to return, it may be necessary for Ebco to collect your goods from you and we will normally charge you for collecting the goods if they are not found to be defective. We will inform you if collection is necessary when you contact us about your return.

To arrange for an item to be collected by us, you must firstly contact our customer services at customerservices@ebco-ebikes.co.uk . We will issue a Returns Authority, which must accompany the goods being returned. Items returned without a Returns Authority cannot be accepted.

If we collect your item(s), we will endeavour to send you a replacement or refund your payment within 14 days, providing your Returns Authority is included with the items returned.

Defective items, will, upon receipt of the product, be dealt with in accordance with 7 above.

When returning goods, if no fault is found we do not refund delivery charges and will charge for collecting the goods.

We will endeavour to process returns within 14 working days of receipt.

This does not affect your statutory rights.

11. Colours, Specifications, Weights & Sizes

Representations of colour online are as accurate as our photographic and electronic processes will allow. Please note that colour online can also be affected by the calibrations of different output devices.

All weights and sizes are supplied as a guide only and are approximate.

In view of our policy of continuous improvement in product development and design specifications are subject to change at any time.

12. Safe Shopping Guarantee

For your safety our secure server software encrypts all of your personal information sent over the Internet. In processing your order, your information may have to be sent over the Internet more than once. At no point is your order information sent in this way without encryption.

Although we endeavour to take all reasonable steps to protect your personal information, we cannot guarantee the complete security of any data you disclose online. You accept the inherent security risks of providing personal information and dealing online over the Internet and Ebco cannot be held responsible for any breach of security unless it is due to our negligence.

13. Secure Server Digital Certificate

This website has been issued with a Secure Server Digital Certificate. It confirms that Ebco’s website is a legitimate website and establishes an encrypted communication channel protecting all sensitive and personal information you send over the Internet while you are using this website.

14. Accuracy

This website has been prepared solely on the basis of information available at the time of publishing and is in some respects reliant upon details supplied by third parties. Its accuracy cannot be guaranteed. Whilst we aim to provide accurate information we cannot accept liability for inaccuracies, errors or omissions howsoever arising. Prices are correct at the time of submission to the site, excluding genuine mistakes.

15. Jurisdiction

These Terms and Conditions and any internet sales or any contract or agreement arising there from shall be deemed (notwithstanding any rule of contract to the contrary) to have been made in England and shall be interpreted in accordance with English Law and industry custom and practice, and any disputes in respect thereof  shall be determined by English Courts.
